How tall can a fence be without a permit?

The 7 ft figure frees you from a building permit. It does not tell you how tall to build.

Short answer

7 ft (2.13 m) is the building permit line in both US model codes: the IRC and the IBC exempt "fences not over 7 feet (2134 mm) high". That is not the height you may build. Zoning caps it lower. In the towns compared here a front fence stops at 3 to 4 ft (0.91 to 1.22 m) and a back fence at 6 to 7 ft (1.83 to 2.13 m). England allows 1 m (3 ft 3 in) beside a road and 2 m (6 ft 7 in) elsewhere.

A US fence can be 7 ft (2.13 m) high without a building permit. Both model building codes say so, in the same words: "Fences not over 7 feet (2134 mm) high." But 7 ft is not the height you may build, because zoning rules cap fences lower, with or without a permit. In the towns compared below, a front yard fence stops at 3 to 4 ft (0.91 to 1.22 m) and a back yard fence at 6 to 7 ft (1.83 to 2.13 m). England allows 1 m (3 ft 3 in) beside a road and 2 m (6 ft 7 in) elsewhere, and the rest of the garden is in outdoor room dimensions.

What "without a permit" means for a fence: two rules, two numbers#

A fence answers to two separate rules, which is why the question gets two answers.

A building permit is approval from the building department that a structure is built safely. The model codes list small jobs that need none, and a fence up to 7 ft is one of them.

Zoning is the local law on what may stand where on a lot, and it sets how tall a fence may be in each part of the yard. Some towns check it with a zoning or fence permit and others leave it to you, but the cap applies either way.

A front yard lies between the house and the street, a side yard beside the house, a rear yard behind it. Fairfax County, Virginia says a corner lot has "two or more front yards".

Fence height runs from the ground to the highest point of the fence, gap and post tops included, as the measuring section below sets out.

The two rules are tested separately, and the stricter one wins. Both model codes say so: the exemption "shall not be deemed to grant authorization for any work to be done in any manner in violation of the provisions of this code or any other laws or ordinances of this jurisdiction". The site's guide to how big a shed can be without a permit runs into the same split.

7 ft in both model codes, word for word#

The International Residential Code (IRC) covers houses, and section R105.2 of the 2021 edition lists work that needs no permit. Under "Building", the second item reads: "Fences not over 7 feet (2134 mm) high."

The International Building Code (IBC) covers every other kind of building, and section 105.2 of its 2021 edition carries the same item in the same words.

The two codes differ on sheds but agree on fences. "Not over" is the test, so a fence of exactly 7 ft is exempt under the model text.

Neither code is law until a state or town adopts it, and adopters change the wording. Four places show how much:

  • Belmont, Massachusetts says in its building FAQ that "a fence less than 7 feet tall does not require a building permit". Less than 7 ft is not the same as not over 7 ft: at exactly 7 ft, the two readings part. Belmont adds that it "does not have its own fence regulations".
  • Maplewood, Minnesota follows the model code: its fence page says "no permit is required for residential fences 7 feet in height or less", and over 7 ft takes a permit and a variance.
  • Catskill, New York draws the line lower, and its code enforcement FAQ says no permit is needed "if it is less than 6 1/2 feet in height". At 6 1/2 ft (1.98 m) or more, fences "are considered buildings" and need a building permit and must meet setbacks.
  • Wilsonville, Oregon goes lower again and names the material. Its FAQ says: "No permit is necessary if you are building a wood fence that is less than six feet in height on your own property."

Front yard 3 to 4 ft, back yard 6 to 7 ft: the zoning caps#

The permit line is one number, but the zoning caps are several, one for each part of the yard. Three published sets show the pattern.

Fairfax County, Virginia. Its April 2025 summary of the zoning rules says "in a front yard, a fence or wall cannot exceed four feet in height". With a special permit from the Board of Zoning Appeals, that can rise "up to six feet". In side and rear yards the cap is 7 ft, and a solid fence may reach 8 ft (2.44 m) in a rear yard that backs onto a major road. On lots of 2 acres or more in the R-A to R-1 districts, 7 ft is allowed in any yard. Fairfax adds that "Building Permits are not typically required for fences of any height."

Wauwatosa, Wisconsin. This city next to Milwaukee publishes one table for height and permits:

Where on the lotWauwatosa capPermit
Front yard3.0 ft (0.91 m)Yes; 18 in (46 cm) setback, 40 per cent open, design review
Side yard4.5 ft (1.37 m)No

Rear yard, not beside a street6.0 ft (1.83 m)No
Buildable area of the lot6.0 ft (1.83 m)No
Beside an alley6.0 ft (1.83 m)Yes; 18 in (46 cm) setback
Beside a non-residential lot6.0 ft (1.83 m)Yes

A front fence is also "allowed for decorative use", limited to 20 per cent of the lot's width, and may not be chain link. Toronto, below, follows the same pattern in metric.

Read together, they agree on a shape: the front fence is about waist high and the back fence about head high, with Fairfax at the high end and Wauwatosa at the low one. Outside Fairfax's lots of 2 acres or more, none of them lets a 7 ft fence stand in a front yard, whatever the building code says.

Fence height caps by part of a lot: front yard, side yards and rear yard.Plan view of a lot 110 feet deep and 50 feet wide with the street on the left. A house sits 25 feet back. The same lot under two zoning codes. Wauwatosa, Wisconsin sets the low end of each range and Fairfax County, Virginia the high end. The building code's 7 ft (2.13 m) permit line sits above every cap here and only matches Fairfax's side and rear yards.

Worked through: one fence plan under nine rulebooks#

Take one common plan and walk it through each rule. Suppose a lot gets a 6 ft (1.83 m) wood privacy fence along the rear line and down both side lines to the front corners of the house. A 4 ft (1.22 m) wood picket fence runs across the front, along the sidewalk, and nothing encloses a pool. Each cell repeats a ruling made elsewhere on this page.

TorontoToo tall by about 2 cm (3/4 in): 1.2 m capAllowed: 2.0 m capAllowed: 2.0 m cap
EnglandToo tall beside a road: 1 m capAllowed: 2 m capAllowed: 2 m cap

The first three rows are permit rules, and only Wilsonville's "less than six feet" puts any run in doubt. The last four rows are height caps, and three of them reject part of the plan. A permit row that passes says nothing about height: Belmont still holds a corner lot to Section 4.3.7 of its zoning by-law.

To pass in all of them, the plan changes in three places. The front fence drops to 3 ft (0.91 m), and in Wauwatosa it still needs a permit and an open design. The side runs drop to 4 ft 6 in (1.37 m) beside the house. The rear fence stays just under 6 ft at its highest point, which also clears Wilsonville, and that takes more care than it sounds.

Measured from the ground below, gap and posts included#

How the height is taken decides as much as the cap, and the places here use three methods.

From the ground directly below. Wauwatosa measures "vertically from the finished grade directly below the fence to the highest point of the fence", and adds: "Any space between the ground and the bottom of the fence is included." Its own example is a 4 ft 6 in cap: the top "cannot be more than 4 feet 6 inches above grade, regardless of any gap below the fence".

From the average ground on both sides. Toronto measures "from the average grade level measured perpendicular to and one metre away on either side of the fence". Where the ground steps at the fence line, the low side sees more fence than the cap and the high side less.

Above ground level. England's Order gives every limit as a height "above ground level", with no more detail in Class A.

On a slope, stepped panels leave one end of each panel higher off the ground, and under Wauwatosa's rule it is that highest point that counts.

England: 1 m beside a road, 2 m everywhere else#

In England the fence rule that sets the height is a planning rule. Class A of Part 2 of the General Permitted Development (England) Order 2015 lets you put up "a gate, fence, wall or other means of enclosure" without applying for planning permission, within limits. Permitted development is the law's term for work allowed this way, with no application.

The limits, from paragraph A.1:

  • A fence "adjacent to a highway used by vehicular traffic" may not exceed 1 metre above ground level.
  • Any other fence may not exceed 2 metres above ground level.
  • Altering or improving a fence may not take it above its "former height" or the limit, "whichever is the greater", so an old 2.2 m fence can be repaired or improved at 2.2 m.
  • There is no allowance at all within the grounds of a listed building, or for a fence around one.

The Order gives no distance for "adjacent". A front wall on the pavement plainly is, but where the fence is set back, ask the council's planning department first. A 6 ft US panel is 1.83 m, which fits under 2 m with 17 cm (6.7 in) to spare.

Toronto: 1.2 m near the street, 2.0 m elsewhere#

Toronto's Chapter 447 sets heights by where the fence stands, measured as the section above describes. The rows for a house lot are these:

Where the fence standsToronto cap, house lot
Front yard, within 2.4 m (7 ft 10 in) of a street lot line1.2 m (3 ft 11 in)
Front yard, further back than 2.4 m from the street line2.0 m (6 ft 7 in)
On an unroofed deck, away from the street2.0 m (6 ft 7 in) above the deck
Not in the front yard, beside a multi-residential or non-residential lot, a street or walkway2.5 m (8 ft 2 in)
Any other fence2.0 m (6 ft 7 in)

A public lane does not count as a street here, and a front hedge near the street is held to 1.2 m too. Within 2.4 m of a driveway, a fence must be open mesh chain link "or of an equivalent open-fence construction" for 2.4 m back from the lot line, which the city's fence page says "ensures that the view of the boulevard or highway is not obstructed".

A privacy screen on a deck is measured from the deck surface, not the ground, and the guard rules for the deck edge itself are in deck sizes and railing heights.

Pool fences: the one fence with a minimum, 48 in#

Every rule above sets a maximum. A pool barrier has a minimum, and it is the fence most likely to need a permit.

The International Swimming Pool and Spa Code (ISPSC) 2021, section 305.2.1 as Utah adopts it, says the top of the barrier "shall be not less than 48 inches (1219 mm) above grade where measured on the side of the barrier that faces away from the pool or spa". That height must hold for 3 ft (914 mm) out from the barrier, so a raised planter outside it eats into the height. The gap under the barrier may not exceed 2 in (51 mm) over grass or gravel, or 4 in (102 mm) over concrete. Section 305.2.2 adds that openings "shall not allow passage of a 4-inch-diameter (102 mm) sphere".

Local rules repeat the figure: Catskill, New York requires "a 48-inch barrier" around any pool that holds more than 24 in (61 cm) of water. Toronto sets a 1.2 m (47.2 in) minimum enclosure on a house lot, 0.8 in under the US figure.

Permit rules treat pool fences as their own case. Fairfax needs no building permit for most fences, but "if a fence is required ... as a barrier for a swimming pool, a building permit is required". Catskill's code exempts only fences "not part of an enclosure surrounding a swimming pool". Toronto requires a permit for the pool and its enclosure.

So a 4 ft pool fence can need a permit where a 6 ft privacy fence does not. Where the ISPSC figure applies in a Fairfax front yard, the 4 ft cap and the 48 in minimum are the same number, with no room either way.

A 48 in side gate, and the patio the fence screens#

A gate in a side fence is the route for bins, bikes and a mower. Garden path widths and outdoor step dimensions gives 48 in (1,220 mm) for a main garden path. Our recommendation, not a code rule, is a gate no narrower than the path that leads to it.

A 6 ft rear fence often screens a patio, whose paving and furniture band are worked out in patio sizes and layouts. It is also an obstacle for play equipment: the space a trampoline needs is measured from fences too. Mark the fence line at full size before you dig, as in taping out a layout, so you can see where the front yard ends and each height change falls.

Where these numbers stop applying#

The figures here are the 2021 model codes and the rules of the places named, as each publishes them. Your own town may differ from all of them, and its zoning code decides. A homeowners' association, a deed covenant or a lease can be stricter, and none is covered.

This page does not cover masonry walls, which Fairfax treats apart from fences. It requires a building permit for concrete or masonry walls of 6 ft or more, and for retaining walls with more than 3 ft (0.91 m) of unbalanced fill, and for fences required for pedestrian safety. A fence that holds back soil is a retaining wall, with its own rules.

A pool barrier at 48 in has passed one test of several. The ISPSC also sets the gaps and openings quoted above, and rules for gates, doors and alarms that this page does not cover. Nor does it cover Wales, Scotland, Northern Ireland, the rest of Canada or Australia, or corner sight rules such as Belmont's, which can keep a fence lower near a junction.

Metric figures are the sources' own where they print them and conversions otherwise, as imperial and metric dimension systems explains. The unit converter does the rest. Terms such as guard are defined in the glossary, and the codes behind this page are indexed under standards and codes.

Frequently asked questions#

Do I need a permit for a 6 foot fence?

Not a building permit under the US model codes, which exempt fences up to 7 ft (2.13 m). Local rules can still catch it. Wilsonville, Oregon frees a wood fence only when it is under 6 ft, so exactly 6 ft is outside that line. Wauwatosa, Wisconsin allows 6 ft behind the house with no permit but only 4.5 ft (1.37 m) in a side yard. Near the street, a 6 ft fence breaks every front yard cap compared here, unless a special permit or a large lot allows it.

How tall can a front yard fence be?

In the places compared here, 3 to 4 ft (0.91 to 1.22 m). Fairfax County, Virginia allows 4 ft, or up to 6 ft with a special permit from its Board of Zoning Appeals. Wauwatosa, Wisconsin allows 3 ft, with a permit, an 18 in (46 cm) setback and an open design. Toronto allows 1.2 m (3 ft 11 in) within 2.4 m of the street line. England allows 1 m (3 ft 3 in) beside a road used by vehicles.

Is it 6 or 7 feet for a fence without a permit?

Both figures are real, from different rules. Seven feet is the building permit exemption in the IRC and IBC. Six feet is Wauwatosa, Wisconsin's zoning cap for a rear yard, and some towns use it as their permit line: Wilsonville, Oregon frees a wood fence under 6 ft. Catskill, New York sits between them at 6 1/2 ft (1.98 m). Your town's own figure decides, so ask it before you buy panels.

How high can a garden fence be without planning permission in the UK?

In England, 2 m (6 ft 7 in) above ground level, and 1 m (3 ft 3 in) where the fence is next to a road used by vehicles. That is Class A of Part 2 of the General Permitted Development Order 2015. A fence at a listed building, or in its grounds, gets no allowance at all. Repairing or improving an older fence that was already taller is allowed up to its former height.

How is fence height measured?

From the ground to the highest point of the fence, including any gap under it. Wauwatosa, Wisconsin measures from the finished grade directly below the fence, and says the gap at the bottom counts. Toronto takes the average ground level 1 m (3 ft 3 in) away on either side, which matters where the ground steps. A pool barrier is measured on the side facing away from the pool.

Does a pool fence need a permit?

Usually yes, even when ordinary fences do not. Fairfax County, Virginia, which needs no building permit for most fences, requires one for a pool barrier. Catskill, New York lists fences as exempt only if they are not part of a pool enclosure. Toronto requires a permit for the pool enclosure. A pool barrier must also be at least 48 in (1,219 mm) high under the ISPSC, the one place fence rules set a minimum.

Can my neighbour build an 8 foot fence?

Not without a building permit under the US model codes, which stop the exemption at 7 ft (2.13 m), and the zoning caps compared here are lower still, except Fairfax County's 8 ft (2.44 m) rear fence beside a major road. Maplewood, Minnesota asks a permit and a variance for any residential fence over 7 ft. Belmont, Massachusetts warns that fences over 7 ft are treated as spite fences and invite disputes. In England a fence over 2 m (6 ft 7 in) needs planning permission.
